Yorgen Fenech’s British lawyer Wayne Jordash QC accused the Council of Europe rapporteur Pieter Omtzigt of producing a report about the assassination of Daphne Caruana Galizia replete with inaccuracies and shortcomings.
In a letter written to Omtzigt on Tuesday, Jordash said that the rapporteur, is playing the role of a prosecutor or judge. He was reacting to what Omtzigt said three days ago, following Fenech’s lawyer appeal to help address an “inflammatory and prejudicial media campaign” against his client.
Yorgen Fenech is accused of complicity in the murder of Daphne Caruana Galizia.
Jordash criticized Omtzigt’s report to the Council of Europe, saying it breached Fenech’s fundamental rights, to a fair hearing and the rule of law.
He added that Omtzigt doubted the integrity of Dr Charles Mercieca, even though he was cleared of any wrongdoing.
Jordash added, that Omtzigt failed to mention Dr Gianluca Caruana Curran’s version of events in the alleged bribing of Times of Malta journalist Ivan Martin to help Fenech get good press. Caruana Curran denied any wrong doing.
Fenech’s English lawyer alleges that Omtzigt’s report fails to mention that Yorgen Fenech is pleading not guilty to the murder charges brought against him.
In the report, Omtzigt said Fenech accused Keith Schembri with involvement in the murder, however, Fenech’s legal team objected to the fact that nowhere in the report was it mentioned that Fenech denied his involvement.
Jordash says that the Dutch rapporteur was not truthful when he wrote that Fenech was planning to escape from Malta, prior to being arrested. The British lawyer says that Fenech always denied that he ever planned to escape from Malta.
“Mr. Fenech has no reason to hide,” the lawyer said.
Dr Jordash demanded an apology for his client and his legal team for what he consides to be inaccuracies in the report.
