Victim of road incident dies two year later; accused found not guilty

Emerson Vella has been found not guilty of causing a woman’s death, who died two years after being involved in a road incident. However, he was found guilty of reckless driving, and was therefore fined €3,000.

The Court heard how on the 9th of August 2015 at around 1.30am, a traffic incident in Dun Karm Street in Birkirakara was reported, stating that two vehicles collided, resulting in a woman being pushed to the ground.

Following preliminary investigations, the Police were informed that the victim, Catherine Fenech, was assisting her son, whose car had stopped due to rain. While the victim was opening her door, the accused hit the car and the woman. She was transported to hospital where she was certified as being in critical condition.

Vella was taken to a police station, where a breathalyzer test showed that he had been driving under the influence of alcohol. The Court heard that the victim died on 1st April 2017, two years after the incident.

The Court, presided by Magistrate Joe Mifsud found Vella not guilty of causing Fenech’s death, although it did find him guilty of reckless driving. Apart from being fined €3,000, his licence has also been suspended for a year.
