Soldier acquitted; ‘mistaken identity’

A 24-year-old soldier from Naxxar has been found not guilty of grievously injuring a woman who was punched in her face during an argument in Paceville.

The incident happened on 1 May 2017.

The alleged victim had told the police that a fight broke out in a Paceville club between two men, including the accused. The woman was punched after the security grabbed her brother. She had lost consciousness and was hospitalized.

The incident was reported hours after it happened and the accused was not immediately identified by the victim.

The accused denied involvement. CCTV footage did not provide proper coverage of the fight.

The Court said that the prosecution had not proven its case beyond reasonable doubt, noting that conflicting accounts had been given.

Presiding magistrate Joe Mifsud said that he was inclined to consider this as a case of mistaken identity.

The accused was found not guilty of assaulting or offending the victim, however, he was found guilty of disturbing public order and was given a warning.
