One has the right to feel secure at home – Court


Magistrate Yana Micallef Stafrace said that family members have a right to feel secure at home to a man who appeared before court facing charges related to domestic violence.

The 31-year-old man from Birkirkara was arraigned in court accused of slightly injuring his partner and son on New Year’s day and of threatening them, the following day.

The parties approached the bench and the case was discussed out of earshot of the public. It was only after that the defence lawyers entered a guilty plea that the Magistrate then explained to the accused, who is not being named, that he would be given a suspended prison sentence for three years. The Magistrate stated that although she is not fully convinced, she will still give him this chance. She further added that domestic violence is quite incomprehensible to her because “no one should want to hurt those who they supposedly love”.

She also explained that according to her, the role of a man in a relationship is to protect and provide for the family, and not become their problem. She told the man that he should act his age and show his son that when he grows up and has a partner, he should not act stupidly.
