Another sitting in the constitutional proceedings initiated by murder suspect Yorgen Fenech is scheduled to take place on Tuesday morning. Fenech initiated proceedings in an attempt to remove lead investigator Police Inspector Keith Arnaud from the murder investigation into the assassination of Daphne Caruana Galizia.
Arnaud has told the court that used to keep former Prime Minister Joseph Muscat updated on the case.
Self-confessed middleman Melvin Theuma and Yorgen Fenech have both revealed that former Assistant Commissioner Silvio Valletta was leaking information.
"It was funny because he was a homicide investigator. But we've put it passed us," he says.
Asked whether he was from the District Police Station, Dr Caruana Galizia said 'no, he was from the CID'.
Judge Mintoff intervenes saying that this was not relevant to the ongoing constitutional case.
Dr Caruana Galizia was informed by Police Inspector Kurt Zahra about his wife's murder. He recalled rushing from Valletta to Bidnija.
'I had asked him, if she had died, and he replied yes,' Dr Caruana Galizia said.
'The children and I have full confidence in Police Inspectors Keith Arnaud and Kurt Zahra,' Dr Caruana Galizia told the court.
He also mentioned a two-hour meeting in October before Fenech's arrest.
The witness said that he was not certain however whether the investigation started after Fenech was arrested.
State advocate Victoria Buttigieg asked about the alleged leaks. He told the court that he was aware about the "leaks issue". He recalled a meeting with Assistant Commissioner Ian Abdilla and two other Police Inspectors.
Economics Crimes Unit Head Ian Abdilla was set to appear this morning, however, he could not make it.
Judge Lawrence Mintoff presided over the case.
Lawyers Dr Gianluca Caruana Curran and Marion Camilleri are appearing for Yorgen Fenech.
State Advocate Victoria Buttigieg is appearing for the state.
